1. OBJECT
These General Conditions of Sale have as their object the purchase of products made remotely via the web on the site https://shop.foodness.it, sold directly by Foodness Spa, Via Dell’Agricoltura 8/10, 46030 Curtatone (MN) (hereinafter Foodness ), registered with the Chamber of Commerce of Mantua with the number 209814, Fiscal Code 01930570203, VAT number: IT 01930570203.
Foodness Spa, Via Dell’Agricoltura 8/10, 46030 Curtatone (MN) markets and partly produces the products on the Site.
2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
These Conditions of Sale must be examined and accepted online by Customers of the site https://shop.foodness.it before confirming the purchase. The order therefore implies full knowledge of the Conditions of Sale and their total acceptance. The Customer undertakes and is obliged, once the online purchase procedure has been concluded, to print and keep these Conditions of Sale, already viewed and accepted during the purchase procedure carried out.
Foodness Spa reserves the right at any time to modify these Conditions of Sale by publishing a new version on this website. The applicable conditions of sale are those published on the site at the time the order is placed, as examined and accepted by the Customer.
3. WARRANTY
Foodness Spa declares that the products that will be delivered are compliant with those present and described on the online site and that the images of the products are to be considered illustrative and not binding.
Any obvious defects must be reported by the Customer in accordance with the provisions of Legislative Decree no. 206 of 2005 art. 132.
The products purchased on the site https://shop.foodness.it are subject to the discipline, where applicable, of Legislative Decree 206/2005 on consumer protection and, for anything not contemplated therein, to the specific provisions provided for in the Civil Code.
With the exception of the replacement of defective and non-compliant products, Foodness Spa assumes no responsibility for direct and indirect damages that may arise from the use, even improper, of the product by the recipient.
The guarantee is personal and will therefore apply only to the original purchaser. Any defect in the products must be reported in writing by the Customer and documented with relative photographic material within the legal deadline at the time of returning the defective product, which must be previously authorised by Foodness Spa.
Foodness Spa reserves the right to verify the actual existence of the defect reported by the Customer and the customer has the discretion to choose between the compensation methods indicated in the return conditions. The request will be processed only if the following documents are present in the returned package: order number and date, detailed description of the defect found and the intact product in its original packaging.
The costs of returning the goods to the sender remain the responsibility of the Customer.

4. PURCHASE METHODS
The purchases of the products, available online and described in the relative detailed sheets, are made by the Customer at the indicated price, increased by any transport costs, as specified below. The Products are depicted and made visible on the Site accurately and corresponding to the characteristics actually possessed. Foodness Spa, in any case, is not able to guarantee the exact correspondence to reality in relation to the images and colours as they appear on the Customer's monitor, if the discrepancy depends on the latter. Before confirming the order, the Customer will be given a summary of the unit cost of each product chosen, the total cost in the case of purchasing multiple products and the transport costs. With the confirmation of the order, the Customer will receive an email message containing the details of the order.
5. PRICES
All prices listed on the site are to be understood as prices including VAT. The prices applicable for the products ordered by the Customer are those that appear on this site on the date the order is transmitted. Prices may be modified at any time, without notice, even for any promotions. Prices do not include shipping costs. Shipping costs are invoiced on the basis of the tariffsffe indicated on this site on the date the order is transmitted and can be modified at any time without notice. Prices are expressed in Euros.
6. INVOICING
It is possible to request an invoice for the order placed. Simply send an email with the request to helpdesk@foodness.it indicating all the necessary data, within a maximum of 2 days of payment.
7. ORDER RECEPTION
https://shop.foodness.it is an e-commerce that offers the possibility of purchasing soluble drinks in compatible capsules. Purchases of products, available as illustrated and described online in the relevant descriptive sheets, are made by the customer at the price indicated therein, to be confirmed at the time of sending the order confirmation, in addition to the transport costs as specified below and in any case displayed at the time of purchase.
Before confirming the purchase, the Customer will be shown a summary of the unit cost of each chosen product, the total cost in the case of purchasing multiple products and the relative transport costs. By confirming the purchase, upon completion of the transaction, the Customer will receive an email containing the Date and Total Amount of their order (for payments via bank transfer, PayPal, Credit Card).
8. DELIVERY OF GOODS AND SHIPPING COSTS
All orders placed will be delivered to the shipping address specified by you when placing the order, which may be your home or workplace. In order for the delivery to be successful, you will be responsible for checking that the address is correct, also leaving your telephone number and your email address and that the instructions on the doorbell/intercom button panel are clear and correspond to the name you indicated to receive the goods you purchased.
If there are problems with the processing or delivery of the order, it is important that you can be contacted in order to agree on any changes.
In the days following the order, please check your email, as we may have sent you some communications regarding the processing of the order.
Orders will be processed within 24/48 hours (Monday to Friday) from the moment of final acceptance of the order, which is understood only as having been credited to our account with your payment.
It is your responsibility to verify the quantity and good condition of the goods upon delivery.
All shipments travel at the buyer's risk: Foodness Spa does not assume any risks arising from transport and/or variation in delivery times.
The shipping costs applied to each order vary based on the products chosen by the customer and the destination of the goods.
The Minor Islands and remote areas may have longer delivery times and higher shipping costs which will be specified on the cart checkout page.
The costs relating to shipments abroad will always be borne by the customer.
9. PAYMENT METHODS
- Credit cards (even without having a Paypal account): it is possible to make purchases using Visa, Mastercard, American Express, Maestro, JCB and Diners credit cards.
- Paypal: you can pay with your PAYPAL account
10. RIGHT OF RETURN
In the event that the customer is not satisfied with the items purchased, he has the right to exercise the right to return part or all of the goods in an order without any penalty. The customer can exercise the right of return within 15 working days from the date of delivery of the purchased products. The request must be sent by email to the following email address helpdesk@foodness.it and must specify the order number, the item(s) you wish to return, the reason and contact details.
Foodness Spa will respond by email authorizing the return of the goods. The shipment of the products to be returned can be made with any means chosen by the customer, but it is advisable to send them with traceability as the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer. However, Foodness Spa will not accept return shipments with freight collect under any circumstances. Shipping costs will therefore be borne by the customer.
Once the returned products have been received, Foodness Spa reserves the right to verify the integrity of the goods, to ensure that the returned products are in the same condition in which they were delivered. Verification may take up to 5 working days. Only after certifying the condition of the returned items, Foodness Spa will provide the refund within 14 days of receiving the returned goods.
Attention: The following will not be accepted for replacement:
- Privacy productsvi of original or open packaging;
- Used products;
- Products damaged due to improper treatment by the customer;
- Packages returned cash on delivery or freight collect.
Furthermore, in all cases, the application of labels or adhesive tape directly on the original packaging of the product must be avoided, under penalty of non-acceptance of the return.
11. REFUNDS
The Customer will be entitled to a refund of the price paid for the purchase of a product if he/she is not satisfied with the purchase made. Shipping costs remain the responsibility of the Customer.
The refund will be made in the following ways:
- CREDIT CARD: for orders paid by credit card, the amount will be reversed from our systems and made available again on the customer's account statement according to the times established by the bank that issued the card (generally the following month).
- PAYPAL: for orders paid by Paypal, the refund will be made directly to the Paypal account: a reversal on the transaction will be requested at the customer's expense, net of the cost of the operation.

Any complaints by the customer must be addressed by registered mail with return receipt to:
